These Terms of Service ("Terms") govern your use of findlandsurveyor.com (the "Site"), operated by Find Land Surveyor, operated by Nathaniel Peters, an individual residing in the Province of Quebec, Canada. By using the Site or submitting any request through it, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. The Site is a directory and lead-routing service
The Site is an online directory of land surveying firms operating in the United States. The directory is compiled from publicly available state licensing board records and public business data. We provide a free service that allows property owners to discover licensed surveyors in their area and to submit a request for an estimate. We do not provide land surveying services, professional advice, or any service requiring a license.
2. We are not your agent and do not endorse any surveyor
Inclusion of a surveyor in the directory does not constitute an endorsement, recommendation, or warranty of any kind regarding that surveyor or their services. We do not pre-screen, supervise, or guarantee the work of any surveyor listed in the directory. The relationship you form with any surveyor is solely between you and that surveyor. We are not a party to any agreement, transaction, or dispute between you and a surveyor.
Before engaging any surveyor, you should independently confirm their licensing status, insurance, references, and suitability for your specific project.
3. No professional advice
Content on the Site, including guides, articles, cost ranges, and FAQ answers, is provided for general informational purposes only. It is not legal, surveying, engineering, financial, or professional advice and should not be relied on as a substitute for advice from a qualified licensed professional. Cost ranges shown are estimates compiled from public sources and individual quotes and may not reflect what you will actually pay for your specific project.
4. Estimate requests
When you submit an estimate request, you authorize us to share the contents of your request with one or more licensed land surveyors serving your requested area, and you authorize those surveyors to contact you by phone, SMS, or email about your project. See our Privacy Policy for details on how we handle the information you submit.
You are responsible for ensuring that the information you submit is accurate. Submitting false, misleading, or fraudulent requests is prohibited and may result in your access to the Site being terminated.
5. Acceptable use
You agree not to:
- Use the Site to harass, defraud, or impersonate any surveyor, customer, or third party;
- Submit estimate requests that are not bona fide inquiries about a real property and project;
- Scrape, copy, or systematically extract data from the Site without our prior written consent;
- Reverse engineer, attempt to bypass security measures, or interfere with the operation of the Site;
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
6. Intellectual property
The Site, including its design, content, guides, articles, source code, and original compilations of public data, is owned by us or our licensors and is protected by Canadian, United States, and international intellectual property laws. You may view and print pages of the Site for personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from the Site without our prior written permission.
Surveyor business names, logos, and trademarks remain the property of their respective owners and are used in the directory for informational and identification purposes only.
7. Disclaimer of warranties
The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim, to the fullest extent permitted by applicable law, all warranties including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful code, or that any information on the Site is accurate, complete, or current.
8. Limitation of liability
To the maximum extent permitted by applicable law, we (including our owner, contractors, and service providers) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Site, your interactions with any surveyor found through the Site, or any content on the Site, regardless of the legal theory of liability, even if we have been advised of the possibility of such damages.
To the extent any such liability cannot lawfully be excluded, our total cumulative liability arising out of or relating to these Terms or the Site shall not exceed CAD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the foregoing exclusions and limitations apply only to the extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless the operator of the Site from any claim, loss, liability, or expense (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your interactions with any surveyor found through the Site.
10. Governing law and disputes
These Terms are governed by the laws of the Province of Quebec and the laws of Canada applicable therein, without regard to conflict-of-laws principles. Subject to mandatory consumer protection laws that may apply where you reside, you and we agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the courts of the Province of Quebec, and you and we consent to the personal jurisdiction of those courts.
11. Modifications
We may modify these Terms from time to time. The "Last updated" date at the top of the page reflects the most recent revision. Material changes will be communicated through a notice on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
12. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy and the Affiliate Disclosure, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.
